NOTICE FOR JOB APPLICANTS

The purpose of this Notice for Job Applicants ("Notice") is to inform individuals who inquire about and/or apply for employment with Alo, LLC, d/b/a Alo Yoga, Bella + Canvas, LLC, and Cody, Inc., a Delaware corporation, d/b/a alo moves (the "Company" or "we" or "us") of the categories of Personal Information (as defined below) that we collect from such individuals, the purposes for which we use such Personal Information.

For purposes of this Notice, "Personal Information" is information that relates to an identified or identifiable person. In addition, "Sensitive Personal Information" is (1) Personal Information that reveals: (A) a person's social security, driver's license, state identification card, or passport number; (B) a person's account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (C) a person's precise geolocation; (D) a person's racial or ethnic origin, religious or philosophical beliefs, or union membership; (E) the contents of a person's mail, email, and text messages unless the business is the intended recipient of the communication; (F) a person's genetic data; and (2) (A) the processing of biometric information for the purpose of uniquely identifying a person; (B) Personal Information collected and analyzed concerning a person's health; and (C) Personal Information collected and analyzed concerning a person's sex life or sexual orientation.

Personal Information and Sensitive Personal Information do not include de-identified, aggregated, or combined information (which includes data that is not reasonably capable of identifying you or being linked to you) and do not include publicly available information from government records.

NOTE: Audio and video from interviews or conversations you have with the Company as a Job Applicant may be recoded and stored for purposes consistent with this Notice.

1. Personal Information Collected from Job Applicants

We may collect the following categories of Personal Information about you when you inquire about and/or apply for employment with us. We may collect and use such information for the purposes identified below, and we may retain such information as identified below. We may share this Personal Information with our service providers, vendors, and other third parties; however, we do not sell this Personal Information. The Company uses Greenhouse, a Service Provider, to support its job applications.

  • to comply with applicable legal and regulatory requests and obligations (including investigations)
  • to establish or defend legal claims and allegations
  • for health and safety, including:
    • to address our legal obligations in relation to health and safety in the work place
    • to protect the health and safety of employees and third parties
  • for security purposes, including:
    • to prevent, detect or investigate fraud, suspected or actual illegal activity, violations of company policy or rules, or other misconduct
    • to investigate security breaches and misuse of computer equipment and systems
    • to protect our property from theft, vandalism and damage
  • to seek advice from lawyers, auditors and other professional advisers
Employment Details and Qualifications, such as current company, job title, employment background, education, and any other information you choose to provide in your resume, cover letter, and/or applications. 7 years
Application Information, such as how you learned of the job, start date, referral and/or recommendation details, take home tests, recruiter information, and any other information you choose to provide in your application. 7 years

2. Sensitive Personal Information Collected from Job Applicants

We may collect the following categories of Sensitive Personal Information about you when you inquire about and/or apply for employment with us. We may collect and use such information for the purposes identified below, and we may retain such information as identified below. We may share this Sensitive Personal Information with our service providers, vendors, and other third parties; however, we do not sell this Sensitive Personal Information.

Health and Disability Records, such as information relating to any disability or health condition that is relevant to your job, including the results of any pre- or post-employment physical or screening examination, alcohol and/or drug testing 7 years
Health and Safety Records, such as information relating to health and safety in the work place, accidents and near misses 7 years
Health Screening Information, such as your temperature or responses to health screening questionnaires 7 years

3. Updating Your Personal Information

We invite you to return to our careers website at any time to access your information, update it, or inform us about other qualifications that you would like us to consider. You may also ask us to withdraw your application if you no longer want to be considered for a position at Company. If so, we will withdraw your information and retain it in accordance with the retention periods noted above.

4. Your Individual Rights

In accordance with applicable laws, you have the right to request access to your information held by Company, as well as the right to request amendments to your data, and, if it was collected improperly, the right to request erasure. 5. Transfer of Your Personal Information

We process your personal information in the local country where you submitted your application and through our global recruitment platform. This will involve transferring your personal information, including personal information collected in the EEA and Switzerland, to the United States.

Company is a global organization. As such, some of your personal information may be transferred to or be accessible by individuals outside of the country in which you reside. Some of those countries may have different privacy and data security standards than your country, and some may not require the same level of protection. Your personal information may be stored electronically as well as in off-line files in those countries. Regardless of where Company receives or holds your information, we take measures to protect your information.
